1. Agreement
These Terms are a contract between you and Fernix LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA (“Hiredeck”, “we”, “us”), covering the Hiredeck mobile app and this website. By creating an account or using the app you accept them. If you do not accept them, do not use Hiredeck. Our Privacy Policy forms part of this agreement.
You must be at least 16 years old and legally able to enter into a contract.
2. What Hiredeck does — and the authority you give us
Hiredeck shows you real job openings, uses AI to draft a résumé and cover letter for a specific role, and — when you approve — submits that application to the employer under your name, through the employer’s own applicant tracking system.
You appoint us as your agent for the limited purpose of submitting applications you have approved. This means:
- Applications are sent as you, with your name and contact details, exactly as a manual application would be.
- By default nothing is sent until you approve it in the Review tab. If you switch on automatic submission in Settings, you authorise us to submit without a per-application review — you remain responsible for what is sent.
- A submitted application cannot be recalled. We cannot edit, withdraw, or delete it once it reaches the employer. Treat approval as final.
3. Your responsibilities
- Accuracy is yours. The application carries your name. You must review drafts and ensure everything submitted — work history, résumé content, and form answers — is truthful. Do not use Hiredeck to send false or misleading information to an employer.
- Your account. Keep your sign-in secure. You are responsible for activity under your account.
- Only your own identity. Do not apply as someone else or upload a résumé that is not yours to use.
- No misuse. Do not attempt to break, overload, reverse-engineer, or scrape the service, or use it to spam employers.
4. What we do not promise
Hiredeck sends applications. It cannot make anyone hire you.
- We do not guarantee interviews, replies, offers, or any hiring outcome. Any figures on our marketing pages are illustrative, not a promise.
- We do not guarantee that every application succeeds. Employer forms change, boards go down, and some forms cannot be read reliably. When a submission fails, we tell you plainly and it costs you nothing (see section 5).
- Job listings come from employers’ own career boards. We do not control their accuracy, and a role may be filled or withdrawn before you apply.
- AI-generated drafts can contain errors. That is why you get to read them before they go.
5. Credits and payment
- One credit sends one application. Credits are bought in one-time packs through the App Store. They are not a subscription and there is nothing to cancel.
- Credits never expire.
- You are only charged a credit when an application is actually submitted. If a submission fails, no credit is spent — there is nothing to refund because nothing was taken.
- Your balance is tied to your account, not to the device. Sign in to the same account to reach it. Because credit packs are consumable purchases, keep access to the account you bought them with.
- Payment and refunds are handled by Apple. We do not process your card or issue refunds directly; request a refund through Apple using their standard process. Where consumer law gives you a right of withdrawal, that right is unaffected by this section.
- We may change pack prices for future purchases. Credits you already hold are not affected.
6. Employers and third-party services
Applications are delivered through third-party applicant tracking systems (Greenhouse, Lever, Ashby) that we do not control. Their availability and behaviour are their own. Employers decide independently what to do with your application, and their privacy policies govern the data they receive.
Hiredeck submits applications the way a person would — completing the employer’s published application form. We do not attempt to defeat, bypass, or disguise ourselves against any anti-automation or verification measure a site uses. If a site asks for a human verification step, that application is handed back to you to finish yourself rather than worked around.
7. Your content
Your résumé, work history, and answers remain yours. You grant us a limited licence to store, process, and transmit them solely to operate the service for you — including sending them to the employers you choose and to the AI provider that drafts your documents. We do not use your résumé to train AI models and we do not sell your data. This licence ends when you delete your account, except for what we must keep by law.
8. Our content
The Hiredeck app, website, name, and branding are ours and protected by intellectual property law. You may use the app as intended; you may not copy, resell, or create derivative services from it.
9. Suspension and termination
You may stop using Hiredeck at any time and delete your account from Settings → Delete account. We may suspend or close an account that breaches these Terms, particularly one used to submit false information to employers or to abuse the service. If we close your account without cause, we will refund unused credits you paid for.
10. Liability
Hiredeck is provided “as is”. To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost job opportunities, or lost earnings. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
Nothing here limits liability that cannot legally be limited — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all mandatory rights under the law of your country of residence, and nothing in these Terms overrides them.
11. Changes
We may update these Terms. If a change is material we will update the date above and notify you in the app before it takes effect. Continuing to use Hiredeck after that means you accept the new Terms.
12. Governing law
These Terms are governed by the laws of the State of New Mexico, United States, and disputes are subject to the courts of the State of New Mexico, United States. If you are a consumer, you may also bring proceedings in your country of residence and benefit from its mandatory consumer protections.
